By accessing or using Real Estate FU, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Real Estate FU platform, website, and services (collectively, the "Platform"). By creating an account or using our Platform, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Platform.

2. Platform Description

Real Estate FU is a platform that connects property buyers and sellers directly while also providing mortgage lending services, reducing traditional real estate transaction costs. We provide tools, technology, and support to facilitate transparent real estate transactions and affordable financing.

Important: Real Estate FU operates as both a technology platform/marketplace AND as a licensed mortgage lender. While we are not a party to transactions between buyers and sellers in our marketplace capacity, we ARE a party to mortgage transactions when you obtain financing through us. We do not act as your agent or fiduciary in real estate transactions.

3. Mortgage Lending Services

MORTGAGE LENDING DISCLOSURE:

Real Estate FU is a licensed mortgage lender. Licensed by the Department of Financial Protection and Innovation under the California Residential Mortgage Lending Act.

EQUAL HOUSING LENDER - We comply with all federal and state fair lending laws.

3.1 Mortgage Application Process

When you apply for a mortgage through Real Estate FU, you are entering into a lending relationship governed by federal and state lending laws, including but not limited to:

  • Truth in Lending Act (TILA) and Regulation Z
  • Real Estate Settlement Procedures Act (RESPA)
  • Equal Credit Opportunity Act (ECOA)
  • Fair Housing Act
  • Home Mortgage Disclosure Act (HMDA)
  • California Residential Mortgage Lending Act
  • Secure and Fair Enforcement for Mortgage Licensing Act (SAFE Act)

3.2 Required Loan Disclosures

In compliance with federal and state law, you will receive the following disclosures:

  • Loan Estimate (LE): Provided within 3 business days of application, detailing estimated loan terms, projected payments, and closing costs
  • Closing Disclosure (CD): Provided at least 3 business days before closing, showing final loan terms and closing costs
  • Servicing Disclosure Statement: Informing you whether we intend to service your loan or transfer servicing
  • Affiliated Business Arrangement Disclosure: If we refer you to related service providers
  • Your Home Loan Toolkit (Special Information Booklet): For purchase money loans
  • Mortgage Servicing Disclosure: Explaining loan servicing and your rights

3.3 Credit Authorization and Verification

By submitting a mortgage application, you authorize Real Estate FU to:

  • Obtain your credit report from one or more credit bureaus
  • Verify employment, income, assets, and other information provided
  • Share your information with service providers, investors, insurers, and government agencies as required by law or necessary to process your loan
  • Order property appraisals, title searches, and other necessary reports

3.4 Loan Approval and Conditions

All loan applications are subject to underwriting approval. Approval is not guaranteed and depends on:

  • Credit history and credit score
  • Debt-to-income ratio
  • Employment and income verification
  • Property appraisal meeting loan-to-value requirements
  • Clear title and acceptable title insurance
  • Satisfactory property condition
  • Compliance with all applicable underwriting guidelines

We reserve the right to deny any loan application or withdraw conditional approval if underwriting conditions are not met. If your application is denied, you will receive an Adverse Action Notice explaining the reasons.

3.5 Equal Housing Lender Policy

Real Estate FU is an Equal Housing Lender and is committed to fair lending practices.

We do not discriminate on the basis of race, color, religion, national origin, sex, marital status, age (provided you have the capacity to contract), disability, familial status, sexual orientation, gender identity, source of income, or any other characteristic protected under federal, state, or local law.

All credit decisions are made based on creditworthiness and ability to repay, not on prohibited factors.

3.6 Complaints and Consumer Protection

If you have a complaint regarding our mortgage lending services, please contact us immediately. We are committed to resolving complaints promptly and fairly.

4. Real Estate Marketplace Services

4.1 Marketplace Role

In our capacity as a real estate marketplace, Real Estate FU connects buyers and sellers. We are not a party to these transactions and do not act as an agent or fiduciary for either party. You are responsible for conducting your own due diligence.

4.2 Listing Requirements

When listing a property, you represent and warrant that:

  • You have the legal right to sell or lease the property
  • All information provided is accurate and not misleading
  • Photos and descriptions accurately represent the property
  • You comply with all applicable fair housing laws
  • You will respond promptly to legitimate inquiries
  • You will disclose all material defects as required by law

5. User Accounts

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be at least 18 years old
  • Accept responsibility for all activities under your account

6. User Conduct

You agree NOT to:

  • Violate any laws or regulations
  • Post false, misleading, or fraudulent listings
  • Harass, abuse, or harm other users
  • Scrape, copy, or misuse Platform content
  • Provide false information on a mortgage application (this is a federal crime)

7. Disclaimers and Limitations

IMPORTANT DISCLAIMER:

Real estate and mortgage transactions involve significant financial and legal considerations. While we provide tools and services to facilitate these transactions, you should consult with qualified professionals (attorneys, inspectors, appraisers, financial advisors) before making decisions.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Real Estate FU, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or our services.

Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim, or $1,000, whichever is greater.
